Terms of Service

1. Introduction

Welcome to Sartorium (https://www.sartorium.net). These Terms of Service ("Terms") govern your use of the Sartorium website and platform. By accessing or using our website, you agree to be bound by these Terms.

You are contracting with DIRO s.r.o., the company identified in the next section; Sartorium is the name under which it trades. If you do not accept these Terms, do not use the platform. We may amend them, and a significant change is announced by email to the address on your account before it takes effect; the date at the head of this document says which version is in force. Continuing to use Sartorium after an amendment we have announced means you accept it, and if you would rather not, you can close your account.

3. Description of Service

Sartorium is the digital infrastructure for classic elegance, connecting menswear enthusiasts with global artisans.

• —For individual users, we provide a map and directory to discover sartorial locations and book services.
• —For businesses, we provide a platform to manage marketing, view analytics, and host trunk show bookings.

The directory and the house pages are reserved for signed-in members: that is the rule, and it is the whole of it. Every page that describes or sells Sartorium — the landing, what it links to, the pricing page and these policies — is open to anyone, and every page that shows the directory needs an account. The only paid product is the subscription a house takes for its showcase, described on our pricing page.

4. Payments and Merchant of Record

Our order process, tax calculation, and invoicing to end-users are conducted by our Merchant of Record, Paddle.com. Paddle is the entity that you legally purchase the software services from. All payment-related inquiries, refunds, and billing disputes are subject to Paddle's Buyer Terms, published at https://www.paddle.com/legal/checkout-buyer-terms, which govern the commercial terms of your purchase: fees, payment terms, taxes, billing frequency, renewal and cancellation.

In outline: a subscription is billed in advance, monthly or annually as chosen at checkout, and renews automatically for the same period until it is cancelled. Prices are shown on our pricing page and exclude VAT, which Paddle calculates at checkout. Cancellation and refunds, including a fourteen-day refund window, are described in our Refund Policy.

5. Acceptable Use

The platform, and the curated directory it publishes, are made available for your own use. You must not misuse them, and the following are prohibited.

• —Unlawful use: using Sartorium for any unlawful purpose, or in breach of any law or regulation that applies to you.
• —Fraud and spam: impersonating anyone, claiming a house you have no authority to represent, submitting false or misleading information, or using the platform to send unsolicited or bulk messages to members or to houses.
• —Infringement: reproducing, distributing or otherwise using content that belongs to us, to a house, or to any other third party, outside what the platform is designed to let you do, without the rights holder's permission.
• —Security interference: introducing malware, probing, scanning or testing the platform's defences, attempting to gain unauthorised access to any account, server or data, or interfering with the platform's availability for anyone else.
• —Extraction: scraping, crawling, harvesting or otherwise copying the directory or any substantial part of it, whether by automated means or systematically by hand, and circumventing or attempting to circumvent the rate limits and access controls that protect it. An account gives you the right to read the directory, not to reproduce it.

The directory is a compilation assembled by hand over years, and it is protected as such. A breach of this section is a material breach of these Terms.

6. User Obligations

You must be at least 16 years old to use Sartorium: to open an account, and to give us a name and an email address anywhere we ask for them before there is one. We ask you to confirm it when you register. The access form does not ask, so nothing is checked there and nothing about your age is stored. We do not ask for a date of birth and we hold none. If we learn that an account or a request comes from someone younger, we close the account or we withdraw the request, whichever exists, and we erase what we hold.

By registering on Sartorium, you agree to provide accurate, current, and complete information. The form asks for a name, an email address, a password, and which of the two kinds of account you are opening. There is one name field either way: give the name you want to be known by, which for a house is the house's name. You are responsible for maintaining the confidentiality of your account credentials and for everything done under your account.

7. Suspension and Termination

We may suspend or terminate your access to the platform, in whole or in part, where:

• —you are in material breach of these Terms, including the Acceptable Use section above;
• —a subscription payment is not made when due, or a payment is reversed or charged back;
• —we reasonably believe the account presents a security or fraud risk, to us, to a member, or to a house;
• —you repeatedly or seriously violate these Terms or a policy published on the platform.

Where the matter can be put right, we will tell you what is wrong and give you a reasonable opportunity to fix it before terminating, unless waiting would leave the platform, a member or a house exposed, in which case we may suspend access first and explain afterwards.

You may close your account at any time from your account settings. On termination your access ends and a published house page stops being visible. Your data is deleted as described in our Privacy Policy, except records we are required by law to keep. Termination for your breach does not entitle you to a refund of the period in progress; where we terminate for a reason that is not your breach, we refund the unused part of the period you have paid for.

8. Personal Data of Members Who Contact You

A house that publishes a page on Sartorium receives, through the platform, limited personal data about members who reach out to it: the name, language and requested slot of a member who asks for a trunk-show appointment, and the name, e-mail address and message of a member who writes to it from its page. In receiving that data the house acts as an independent data controller, and agrees to: use it only to respond to and manage that member's request; not use it for marketing, newsletters or profiling, and not add the member to any list, without the member's separate consent; not disclose it to any third party except as needed to answer the member; keep it no longer than necessary and delete it on the member's request; and handle it in compliance with the GDPR. Sartorium relays this data so that the member and the house can deal with each other directly and keeps no copy of a message; once received, what the house does with it is the house's own responsibility.

9. Intellectual Property

Sartorium's own material — the texts, the design, the software, and the curated directory as a compilation — is the exclusive property of DIRO s.r.o. You may not reproduce, distribute or create derivative works from it without our explicit written permission.

The map is not ours. Its tiles come from OpenFreeMap, built with OpenMapTiles from OpenStreetMap data; that data belongs to the OpenStreetMap contributors and is published under the Open Database Licence. The credits shown on the map name them, and they stay.

What a house publishes stays the house's own — its name, its description, its photographs and the rest of its page. By publishing it on Sartorium a house grants us the licence we need to display it and to promote it on the platform, and withdraws that licence by taking the page down.

10. Service Availability and Limitation of Liability

We work to keep Sartorium available and correct, but we do not warrant that it will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that any particular result will be obtained from using it. Maintenance, upstream failures and changes to the service are part of running a platform, and we may add, change or withdraw features.

The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, DIRO s.r.o. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform or the booking of third-party artisan services.

11. Governing Law

These Terms are governed by the laws of the Czech Republic.

If you are a consumer — an individual acting outside any trade or business — that choice does not take away the protection of the mandatory rules of the country where you live.

A consumer whose complaint we have not been able to settle between us may take it to the Czech Trade Inspection Authority (Česká obchodní inspekce), the body that handles out-of-court consumer disputes for traders established in the Czech Republic; its site is coi.cz. This route belongs to consumers: a house that contracted as a business does not have it, and should write to us at hello@sartorium.net so that we can settle the matter directly.
